【Origin Stories - Fariz Isnaini, AyoBlajar AW#21】
I had a manager once back when I was working for P&G. He was a smart and diligent guy, very successful. I asked him one time whether or not I could be as successful as him and take over the branch office one day. Because I came from an engineering background, he said “no, you are going down a different path, to become a plant director--that should be good enough.” I felt dejected, and wanted nothing more than to prove him wrong.
I ended pursuing a PhD in strategic management from VU Amsterdam, in search of accumulating more knowledge in business. This period of my life was extremely tough. Racial discrimination was rampant and money was hard to come by. I took classes in the day, waited tables at night, and even sold bicycles on the side. This one time I went with my wife to a cafe and bought 2 donuts instead of 1. Despite overstretching our shoestring budget, I just felt like it would be a nice gesture after all our struggles; she cried in response.
During this time I was also active in leading the Indonesian Student Association in the Netherlands, and got a unique opportunity to meet an ex finance minister from Indonesia. He mentioned something that I would never forget: in order to have impact, you need to become a decision maker.
I came back to Indonesia in 2018 and briefly dabbled in politics before setting my sights on the world of startups. After a few failed cold starts spanning tourism to wellness, I decided to target a sector that was critical in putting me on my path in the first place--education.
There’s been so many ups and downs. I’ve almost lost track of our near-death experiences. I don’t think I’m the smartest guy in the room, but I’ve always found a way to climb out of tough situations. I’d have to thank my mom for that. She’s always said “the only limitation you have is in your mind.”

【拜登政府取消針對孔子學院的財務揭露規定?】
2月8日美國保守派媒體國家脈動(National Pulse)發布一條新聞,指出拜登政府取消了川普執政時期提出的一項行政規定,該項規定禁止孔子學院在校園內做宣傳行為。不過,後來根據另外幾家媒體Daily Caller及Newsweek的查核(https://reurl.cc/OXE67v) ,川普政府並沒有這樣的禁令,拜登取消的規定是川普政府在去年12月31日所提出的一個提案,該提案內容是要求各級學校揭露與中國孔子學院合作的內容、財務狀況(牽涉到大約500所高中以下學校及65所大專院校)。
我們觀測站成員第一時間看到這則報導幾乎都是滿臉疑惑,因為防範孔子學院是一個在美國政策圈討論最有共識、最沒有爭議的領域。把一個提案內容也不過就是要求各級學校揭露與中國學術單位的合作關係的規定給取消,實在不知道拜登政府在想什麼。
而昨天新聞一出,已經有很多國會議員們和大牌學者們在推特上討論這件事。有熟悉行政程序的人試著想要解釋,這是因為川普在卸任前的一個月內提出了許多規定、提案、命令和外交決策,所以新政府其實是忙著審閱這些資料,而在審閱完畢之前,這些規定都會先被擱置。不過,因為孔子學院在美國學政界實在是很受矚目的議題,很多人對於前面的說法並不買單,認為拜登政府至少該出來解釋清楚。
就在今天(美國週三),事情有了新的發展。根據美國之音(VOA)記者張蓉湘取得的資料(https://reurl.cc/WEq8le) ,白宮已對此新聞做出了回應。
白宮發言人表示,川普政府時期其實並沒有完成該提案的審查,該提案仍然還在「美國行政管理和預算局」(United States Office of Management and Budget, OMB)的審查階段。而在新政府上台之後,白宮幕僚長克蘭(Ron Klain)提案凍結「所有」未完成審查的提案,這是歷屆新政府上台時的慣例。這則新聞目前也已經被保守派媒體更新,如Fox News(https://reurl.cc/dVeqR8) ,所以應可確定為真。
也就是說,所有仍然處在OMB審查的提案都已經被取消了,將會由行政部門重新提案。這個作法其實跟國會一樣,所有的法案都要在一個會期內解決,如果沒有通過的話,下個會期就要重頭再來,重新提案。
其實這則新聞從2月8日出現以來,馬上就在國會議員和許多學者們推特的討論串中炎上,而白宮方面的反應則是慢半拍。都過了兩天才由一位VOA記者得到白宮方面的回應,實在太慢,而且很不足。目前為止我們可以看到拜登政府的白宮發言團隊常常都有反應不及的問題,戰力顯然還沒上軌道。
現在智庫們都在討論該怎麼樣對抗中國,加上拜登政府各級官員們都說中國是重大的挑戰,許多人的焦點就放在要怎麼樣針對中國的科技業做反制,還有貿易戰該不該、以及接下來要如何繼續進行的討論(貿易戰何去何從的討論非常熱)。
在眾多與中國相關的政策辯論中,針對孔子學院的討論應該是各界最有共識的,不管是國會議員還是候任官員們都表示,孔子學院很有問題。例如被拜登政府提名擔任駐聯合國大使的湯瑪斯—葛林斐德(Linda Thomas-Greenfield),就因為在2019年時曾受邀到孔子學院進行演說,而在之前的參議院聽證會上被輪番質問,到底清不清楚孔子學院在美國的作為。
湯瑪斯—葛林斐德後來也在參院聽證時表示,對於自己曾在孔子學院演講「感到強烈後悔」,認為中國透過孔子學院對資源有困難的美國學校「伸出援手」的做法和她在非洲看到中國以債務陷阱作為外交手段其實很類似,並說她全力支持國會對孔子學院的嚴格管制。由此可以看出,華府大家對孔子學院的疑慮都很深,也幾乎沒有任何人提出反對要對孔子學院做更多的規範。
即便今天白宮出面澄清了,但相關議題的討論絕不會因此停息(我們樂見越來越多人討論),接下來還是要繼續關注拜登政府怎麼應對孔子學院,以及中國不當介入美國校園的問題。
📌 一般來說
美國並不會直接禁掉外國媒體和學術單位,過去美國行政部門採取最重的管制方式包括:宣告該機構為外國代表機構,要求財務揭露等等。在川普時期就宣告很多家中國媒體是「外國代理人」,而不能再隨意利用所謂的言論自由來進行宣傳,且各項活動都必須要報備給國務院。
在學術自由和新聞自由等方面美國很堅持,目前為止還沒有要為獨裁者破例的意思,而是盡可能去要求各方都必須要公開透明。這可能也是為什麼川普政府最後也沒有要求所有孔子學院都要關門,因為這是學術自由的範圍,交由學校來做決定。

2月2日的新聞(https://reurl.cc/YWdkAL) ,美國各地大學基於學術自由考量而關閉校內孔子學院,美國在台協會(AIT)台北辦事處處長酈英傑(Brent Christensen)呼籲,民主台灣應該挺身填補華語教學缺口。酈英傑接受「日經亞洲」(Nikkei Asia)訪問時說,在因應美國學生學習華語的興趣這方面,台灣能「扮演關鍵角色」,且應利用這個機會來宣傳文化和民主。他說:「向台灣教師學習華語,意味能在一個免受審查或脅迫的環境學華語。」

美國國務院去年8月將孔子學院歸類為「外國代表機構」(foreign mission)。十月份時國務卿龐培歐表示,美方將要求各級學校年底前關閉校內的孔子學院。不過最後行政部門在12月31日的提案則只是要求各級學校要揭露與孔子學院的合作關係。
根據媒體Axios的報導(https://reurl.cc/nnZl82) ,川普政府今年一月份時大力推動的幾項政策之一,就包括要求各級學校揭露與中國政府單位的財務往來關係。一份國會調查報告指出,有超過七成以上的學校,每年收到來自中國政府出資單位的贊助款項超過25萬美元,但其中有很多沒有申報。

先前美國聯邦調查局(FBI)起訴了好幾個關於和中國間諜合作的學術單位,用的法條通常是外國代理人法、以及稅務相關法律,主要針對的是「拿了外國政府的錢卻沒有誠實申報」的部份。忘了的朋友可以來複習一下去年一月份震驚全美的「是在哈佛」(https://reurl.cc/pmZKkl)。
